Competition Commission of India fines Google for search bias

The Competition Commission of India on February 7, 2018 imposed a fine of Rs 136 crore on internet search giant Google for unfair business practices in the Indian market for online search.

The ruling was prompted by a complaint filed in 2012 by Indian matchmaking website, Bharat Matrimony, and Consumer Unity and Trust Society, a consumer protection group.

The US internet giant was deemed to have favored its own services when customers ran searches according to a report from the Competition Commission of India (CCI) six years after it began investigations into the company.

This is the latest antitrust setback for the world's largest search engine.

A Google spokesperson called the CCI's concerns "narrow" in a statement.

Speaking after imposing the penalty of Rs 136 crore on Google, a unit of U.S. firm Alphabet Inc, Competition Commission of India has found that Google was using its dominance in online web search and online search advertising markers. The order said prohibitions imposed under the negotiated search intermediation agreements upon the publishers have been held to be unfair as they restricted the choice of these partners and prevented them from using the search services provided by competing search engines.

Based on its findings of contraventions against Google, the CCI imposed a penalty of Rs 135.86 crore after taking into account Google's revenue from its India operations only. While the majority order is by chairperson D K Sikri and three members, two members have issued a dissent order saying that they don't find Google in violation of Section 4 of the Competition Act.

The European Union has slapped 2.4 billion euro fine on Google for manipulating its search engine results to favour its new shopping service. The country's antitrust organization have hit Google with a fine of about $20 million for alleged search bias.

The Google spokesperson said the company has always focused on innovating to support the evolving needs of users.

The regulator said the penalty is being imposed on Google for infringing anti-trust conduct.
