FBI Finds No Evidence of Attack in Death of Border Agent

Over the past three months, the Federal Bureau of Investigation has conducted more than 650 interviews with first responders, medical personnel, and other law officials who may have any knowledge of how Border Security agent Rogelio Martinez died on November 19, 2017.

Martinez and Garland were found injured on November 18 in a rock-strewn culvert that runs under Interstate 10 at about 11:20 p.m.

The office of Gov. Greg Abbott (R-Texas) similarly called Martinez's death a "murder case" and offered a reward of up to $20,000 for information "leading to the arrest and conviction of the person or persons responsible for the murder of a U.S. Border Patrol agent and the serious injury of another". But they are not connected to Martinez's death, or his partner's injuries, the Federal Bureau of Investigation said Wednesday.

The release provided a detail that was not previously made public: when talking to a dispatcher by phone, the second agent "made a statement to the effect of, "We ran into a culvert, ' 'I ran into a culvert, ' or 'I think I ran into a culvert".

Rogelio Martinez died while patrolling in the Big Bend Sector of the border in Texas.

Mr. Garland, who also had major head injuries and broken bones, was later released from the hospital.

Garland, less seriously injured, was taken to the hospital by Border Patrol agents.

Manner of death was listed in the report as "undetermined". The FBI in El Paso said Wednesday it can not find any evidence that an attack led to his death.

The FBI investigation included a search warrant for a 2004 Pontiac Grand Am and the questioning of two brothers based on a tip from an informant.

Shortly after Mr Martinez's death, Culberson County Sheriff Oscar Carrillo cast doubt on the notion that the agent had died in an attack.

An informant familiar with human smugglers told Border Patrol officials that a pair of brothers recently smuggled across the border had admitted to assaulting the agents, according to a warrant later filed to search the brothers' auto in New Mexico.

"As part of this effort, the FBI has investigated multiple theories, including whether the Border Patrol Agents were ambushed or attacked or whether their injuries were as a result of an accident or any other relevant criminal activity", El Paso Special Agent in Charge Emmerson Buie Jr. said in a press statement Wednesday afternoon.

Arizona Rep. Martha McSally, now running for Arizona's open Senate seat called it a "murder" and said it should serve as a "wake up call to our country that we must have the resolve to secure our border and protect Americans from deadly threats like these".

While it remains a mystery what, exactly, happened to Martinez and Garland, there's no reason to believe they were attacked or ambushed. "Our view hasn't changed". His partner suffered head trauma and told investigators he could not remember what happened.

"There's no way he fell and dropped off that culvert", Cabrera said. "It seems to me that they don't have any leads".

He pointed to the lack of injuries on the lower part of Martinez's body. As part of this effort, the FBI has investigated multiple theories, including whether the Border Patrol Agents were ambushed or attacked or whether their injuries were as a result of an accident or any other relevant criminal activity.

"If you got hit from behind and didn't have a chance to defend yourself, then how would you defend yourself?"

The FBI continues to offer a reward of up to $50,000 for information on the case and provides this number: 915-832-5000 to call with information.
