US Sues California Over Law Interfering With Federal Land Sale

The U.S. Department of Justice on Wednesday sued California over a law that aims to give the state power to override the sale of federal lands, the latest battle between President Donald Trump and the nation's most populous state.

"I regret the need to file yet another lawsuit against the state of California today", Attorney General Jeff Sessions said in a statement on the filing of the suit.

The complaint argues that the state law, Senate Bill 50 (SB 50), passed in October 2017, is unconstitutional because it discriminates against the USA and therefore violates intergovernmental immunity and the Supremacy Clause [Cornell LII material]. The Public Lands Protection Act prohibits County Recorders from completing a change of title on these federal lands unless the State Lands Commission has been given a first right of refusal to purchase the land, thereby ensuring their protection.

California officials claim the state doesn't interfere with the actual sale of federal lands, but rather prevents the transfer deeds from being recorded. Examples include conveyance of land to Native Americans, a proposed veteran housing project and other military projects.

The department's lawsuit comes a month after it sued California in an attempt to challenge the state's immigration laws. We are confident that we will prevail in this case-because the facts are on our side.

The lawsuit was filed Tuesday in Manhattan federal court.

"Government-by-litigation isn't what the American people voted for and attempting to thwart an administration's elected agenda through endless, meritless lawsuits is a unsafe precedent", Sessions said.

"Our public lands should not be on the auction block to the highest bidder", California Attorney General Xavier Becerra, a Democrat, said in a statement. "We're prepared, as always, to do what it takes to protect our people, our resources, and our values".

The bill was designed in direct opposition to the Trump administration's policy approach to federal land and motivated by a fear of losing federally designated national parks and wilderness.

Lt. Gov. Gavin Newsom, who is also a member of the Lands Commission and running for governor as well, also promised to fight the Trump administration.

New York Attorney General Attorney General Eric Schneiderman announced the new lawsuit.

The Trump administration on Monday signaled that it will likely upend California's ability to impose stricter standards for vehicle emissions than the rest of the country.

Mr. Trump also blasted Mr. "Jerry "Moonbeam" Brown", highlighted that the crimes he pardoned included "kidnapping and robbery", "badly beating wife", and "dealing drugs".
