USA justice department sues California to over new net neutrality law

Net neutrality has become a rallying cry for liberal activists and younger Americans, who complain of corporate priorities they say are at odds with what they want to see in internet governance. It prevents internet services from slowing their speeds, charging extra fees for major websites, and preventing access to certain websites.

The department will insist that regulating net neutrality is exclusively the responsibility of the federal government and not the state authorities, senior DOJ officials told the Washington Post.

Brown stopped short on Sunday of making California the first state to mandate public colleges and universities offer abortion medication at their health centers.

It is one of several measures affecting women that Brown signed Sunday, his last opportunity to approve or veto laws before the term-limited governor leaves office.

The Department of Justice filed a lawsuit against the state of California on Sunday evening after Gov.

Marc Martin, a former FCC staffer who is now chairman of communications practice at the law firm Perkins Coie, said typical "pre-emption" lawsuits filed by the federal government seek to bar states from ignoring properly enacted federal regulations such as the Voting Rights Act.

The Obama administration had tried to force the same rules nationally, but the Trump administration's Federal Communications Commission overturned those rules in a decision that took effect in June. USTelecom, which represents companies in the broadband sector, said it supports net neutrality but disagreed with the California law.

The U.S. Senate voted in May to reinstate the net neutrality rules, but the measure is unlikely to be approved by the House of Representatives and the White House also opposes it. An identical bill was introduced in NY.

"While the Trump Administration does everything in its power to undermine our democracy, we in California will continue to do what's right for our residents", Wiener said in a statement. The constitutionality of California's law - and whether other states can adopt their own net neutrality rules - depends heavily on the outcome of a pending case in a Washington, D.C., federal appeals court, van Schewick said. SB 822 is the strictest bill on net neutrality in the country so far.
